Unless you are in a college dorm or you lost a significant amount of your income Landlords are hard pressed to allow something like this to happen. In the event you are the Sub-Lessor you are still liable for your lease with the Landlord if the Sub-Lessee fails to pay rent or breaches their lease in any way. Think of the last time you thought about entering into business with someone. Whether you were engaging a consultant hiring an employee sharing your trade secrets with a vendor or providing your private data to a customer youve probably asked the other side to sign a confidentiality agreement protecting your most prized information (or theyve asked you to do so). But this kind of contract shouldnt be some simple hoop to jump through farmed out to your lawyers or contract managers without you paying close attention to the details.
It is likely these laws will override your agreement so it makes sense to line them up so they match. Then you need to put the basics in there. This might include hours of work what their role is and how much they are going to be paid. After this it is a matter of adding some other clauses to protect both you and the employee. This could be to do with dismissal and other situations that might arise. Whatever you do make sure you implement an agreement for each of your team members and get them to read it and sign it when they are happy. It could save a lot of headache in the future. Most legal form companies out there want you to either pay for a subscription based format where you have access to all their forms or you have the website that where you make the agreement on their site and it becomes locked.
Obviously a basic form contract is unlikely to cover all the bases for things like international joint ventures multi-level sales agency relationships or insurance services. These are agreements where the costs of an attorney are justified. Another downside to using an employment agreement template is the potential for building inflexibility into your business. In particular employment law changes may invalidate or make an existing agreement out of date. If you use the same job template for hundreds of employees and the law changes you may need to go back and have them re-sign new contracts. This wont always benefit the company though it is a small risk to take to get the significant legal protections afforded by even the simplest of contracts.
